The newly adopted <a href=\"https:\/\/www.thejakartapost.com\/news\/2020\/10\/05\/omnibus-bill-on-job-creation-passed-into-law-despite-opposition.html\">omnibus Law on Job Creation<\/a>, however, is a huge step backwards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A decade ago, Indonesia <a href=\"https:\/\/www.internationaldisabilityalliance.org\/blog\/indonesia-ratifies-crpd\">ratified<\/a> the United Nations Convention on the Rights of Persons with Disabilities (<a href=\"https:\/\/www.un.org\/development\/desa\/disabilities\/convention-on-the-rights-of-persons-with-disabilities.html\">CRPD<\/a>), adopting the universal human rights principle of respecting the rights of people with disabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since then, Indonesia has introduced about <a href=\"https:\/\/aidran.org\/resources\/disability-policy-in-indonesia\/\">85 policies<\/a>, laws (including the National Disability Law No. 8\/2016), government regulations, presidential and ministerial decrees, and regulations at provincial and village level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The omnibus law, however, puts efforts to bring about social change to <a href=\"http:\/\/www.oit.org\/wcmsp5\/groups\/public\/---asia\/---ro-bangkok\/---ilo-jakarta\/documents\/publication\/wcms_233427.pdf\">almost 24 million Indonesians living with a disability<\/a> in reverse by not inviting people with disabilities in the bill\u2019s deliberation resulting in the law\u2019s discriminatory provisions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">One step forward, two steps back<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The omnibus law has been received with <a href=\"https:\/\/www.cnnindonesia.com\/nasional\/20201012153022-20-557482\/hak-penyandang-disabilitas-disebut-diabaikan-di-uu-ciptaker\">disappointment by people with disabilities<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of opening up equal employment opportunity for all citizens, it discriminates against people with disabilities, preventing them from getting a job.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">People with disabilities <a href=\"https:\/\/www.thejakartapost.com\/news\/2020\/10\/12\/a-form-of-betrayal-disability-rights-activists-criticize-discriminatory-jobs-law.html\">were not consulted <\/a> during the drafting process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lack of participation of people with disabilities resulted not only in the discriminatory directives towards people with disability but also the use of the term <a href=\"https:\/\/nasional.kompas.com\/read\/2020\/10\/07\/18402651\/istilah-penyandang-cacat-dalam-uu-cipta-kerja-menyakiti-perasaan?page=all\">\u201ccacat\u201d or handicapped<\/a> for people with disabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consistent with CRPD\u2019s universal principles, Indonesian policies have uniformly used the term \u201cdisabilitas\u201d (disability) and \u201cpenyandang disabilitas\u201d (person bearing disability).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The term \u201cpenyandang disabilitas\u201d carries a sense of empowerment, dignity, and equality into the self-identity of people with disabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Like the English term \u2018person with a disability\u2019, it places the individual first before their disability, emphasising the potential rather than limitations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To be acknowledged as \u2018penyandang disabilitas\u2019 is giving people with disabilities a new \u201cidentity\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The term \u201ccacat\u201d in the omnibus law is a major set back to the progress Indonesia has made in the past ten years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It contradicts other national legislation and violates Indonesia\u2019s international commitment to the universal principle of disabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The omnibus law discriminates against people with disabilities in access to hospitals and access to reasonable adjustment in the workplace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even worse, Article 154A on Termination of Employment stipulates that individuals can be fired if they become \u201chandicapped\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law also contradicts the National Disability Law in requiring public and private sectors to employ people with disabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, it requires individual who applies for employment to provide proof that they are both mentally and physically healthy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is hugely discriminatory. It goes back to the New Order\u2019s policies towards disabilities.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Negating advocacy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Of all the violations against people with disabilities in the omnibus law, the return of the term \u201ccacat\u201d is considered the most problematic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is because at the heart of the human rights principle of disability inclusion is equality and respecting the dignity of people with disabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Early on in the movement, disability advocates demanded the government <a href=\"https:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/09687599.2016.1200014\">abolish the use of the term \u201ccacat\u201d<\/a> (handicaped), \u201ctuna\u201d (lacking), and \u201ctidak normal\u201d (abnormal).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These terms were introduced under the authoritarian New Order\u2019s administration. Under these labels, the identity of people with disabilities had been about inability, abnormality, incapacity, dependence, and a burden to society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The term \u201corang cacat\u201d or \u201ctuna\u201d relegated people with disabilities to a lower social status. With that status, they did not get equal access to education, employment, health services, social welfare, and to actively participate in social and political development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Further, discrimination in and lack of equal access to, employment is a major barrier to the full participation of people with disabilities in society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not only does the law turn back the clock on appropriate, rights-based language, it effectively locks people with disabilities out of the very opportunity they seek, which is to lead independent and productive lives.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Advocating for change<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that these limitations in the law have gone unchecked, and that it passed parliament and was <a href=\"https:\/\/www.thejakartapost.com\/news\/2020\/11\/03\/jokowi-signs-job-creation-law-making-it-effective-amid-nationwide-protests.html\">signed by President Joko \u201cJokowi\u201d Widodo<\/a> seems like a complete rejection of the efforts by government, disability advocates, and civil society organisations to date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The only way people with disabilities can do now is <a href=\"https:\/\/www.thejakartapost.com\/news\/2020\/11\/05\/civil-labor-groups-bring-job-creation-law-to-constitutional-court.html\">petition the Constitutional Court<\/a> to fully repeal the law or annul provisions that violate constitutional rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This will be a long, tiring, and costly effort for disability advocates.
